Selling a House With Tenants in Middletown, NY: What Landlords Should Know

A question I hear from local landlords is, "Can I sell my house in Middletown, NY if tenants still live there?" Yes, you can. Middletown has plenty of two-family and multi-family homes, and many of them sell with tenants in place every year. The key is planning ahead so the sale goes smoothly for you, your tenants and your buyer. For a feel for the area, see my Middletown, NY neighborhood guide.

Start with the lease

In New York, a sale does not automatically end a lease. In most cases the buyer takes over the existing lease and the tenant stays until it ends. Before you list, pull out every lease and note the end dates, rent amounts and security deposits. Your real estate attorney can confirm what each lease allows. My post on working with a real estate attorney in Orange County explains their role.

Your three main options

  • Sell with tenants in place. This often appeals to investors who want rental income from day one. My post on why multi-family homes make sense in Middletown shows how buyers look at these properties.
  • Wait until the lease ends. A vacant home is easier to show, stage and sell to owner-occupants, including first-time buyers using FHA loans on a two-family home.
  • Agree on an early move-out. Some owners and tenants agree on a move-out date in writing, sometimes with help toward moving costs. Always have your attorney put this in writing.

Keep tenants on your side

Showings go much better when tenants feel respected. Give reasonable notice before every showing, keep visits to set times, and let tenants know what to expect. A clean, cooperative unit photographs and shows better, which helps your price.

Security deposits and rent at closing

Security deposits must be handled properly at closing, typically by transferring them to the new owner and letting tenants know who now holds them. Rent for the month of closing is usually split between buyer and seller. Your attorney will handle these details, but it helps to have clear records ready.

Price it for the right buyer

Investors focus on rent and expenses, while owner-occupants focus on the home itself. Knowing which buyer you are targeting shapes your price and marketing. My guide to selling a home in Middletown covers the full process.
