Selling an Inherited Home in Orange County, NY: A Simple Step-by-Step Guide
By Ammar Iqbal | Real Estate Salesperson, eXp Realty
Inheriting a home is often emotional, and selling it comes with a few extra steps that a normal sale does not have. If you have inherited a house in Orange County, NY and are wondering how to sell it, here is a simple overview of how the process usually works. I am based in Middletown, so you can also see my Middletown, NY neighborhood guide for local context.
Step 1: Confirm who has authority to sell
In most cases, the house cannot be sold until someone has legal authority to act for the estate. In New York this usually means the executor named in the will receives Letters Testamentary, or, if there is no will, an administrator receives Letters of Administration. For Orange County estates, this goes through the Surrogate's Court in Goshen. If the home was held in a trust or passed another way, the steps may be different. An estate attorney can tell you exactly what applies to your situation, and my post on working with a real estate attorney in Orange County explains their role at closing.
Step 2: Protect the house while it sits
Even before a sale, someone needs to keep up with property taxes, insurance, utilities and basic upkeep. Let the insurance company know the home is vacant, since standard policies may limit coverage on empty homes. In winter, keep the heat on and have someone check for frozen pipes and snow.
Step 3: Find out what the home is worth
Heirs often need a value for two reasons: to decide on a list price and for tax records. A free home value estimate is a good starting point, and your accountant or attorney may also ask for a formal appraisal as of the date of death. Inherited property often gets a "stepped-up" tax basis, but tax rules vary, so speak with a CPA before you sell.
Step 4: Decide between fixing up or selling as-is
Many inherited homes have not been updated in years. Some families do a cleanout, fresh paint and small repairs. Others sell as-is to save time and avoid putting money into the estate. Neither is wrong. My post on renovating vs. selling as-is walks through the trade-offs, and closing costs in Orange County shows what sellers typically pay.
Step 5: Agree as a family
When several siblings or relatives inherit together, the biggest delays usually come from disagreement, not paperwork. Talk early about price, timing and how proceeds will be split, and keep everyone informed.
