Do You Need to Sign a Buyer Agreement in Middletown, NY? Working With a Buyer's Agent Explained
By Ammar Iqbal | Real Estate Salesperson, eXp Realty
If you're starting to look at homes in Middletown, one of the first things a buyer's agent will ask is for you to sign a written buyer agreement. Many buyers wonder whether that's required, what it means and how the agent gets paid. Here is a simple explanation. If you're new to the area, start with my Middletown, NY neighborhood guide.
Why Buyer Agreements Are Now Standard
Since August 17, 2024, agents who belong to a Multiple Listing Service and work with buyers need a written agreement with the buyer before touring a home together. That change came from the National Association of REALTORS® settlement, and it applies here in Orange County just like the rest of the country. So if an agent asks you to sign before a showing, they aren't being pushy. It's the rule.
What the Agreement Covers
A buyer agreement spells out the working relationship in plain terms. It typically includes:
- How long the agreement lasts
- The area or type of property it covers
- A clear amount or rate of compensation for the agent
- A statement that commissions are negotiable and not set by law
Read it before you sign and ask questions about anything that isn't clear. You can ask for a shorter term or a narrower agreement, for example one that covers just a single home or a single tour.
How Your Agent Gets Paid
Offers of buyer agent compensation can no longer appear on the MLS, but sellers can still agree to pay part or all of the buyer agent's fee. In many Middletown deals, that is handled as part of your offer. Your agent can help you decide whether to ask the seller to cover the fee, and how that request fits with your price and other terms. Any amount the seller doesn't cover would be paid by you, so it helps to talk about this early.
New York's Disclosure Forms
New York also requires agents to give you an agency disclosure form at the start of a working relationship. It explains who the agent represents. You'll also receive the New York State Housing and Anti-Discrimination Disclosure Form. Signing these forms just confirms you received them.
